License for Paraprofessionals

What does the law say about a license for paraprofessional, who works with Special Education students that have failed traditional Special Education Classes and traditional education classes, in an Alternative School setting. Administrations are denying the license, thus a pay increase, stating that the paraprofessional is not exclusive to the Special Education Department. This particular situation has the paraprofessional teaching/instructing students in core curriculum that the student/students have failed by traditional methods through the Special Educatin Department?
